Article 1: Scope of Application

These general terms and conditions govern the sale of products ("Products") on the websites www.3action.be,  www.3actionsportsnutrition.com, (the "Website") between the consumer ("Customer") and 3ACTION SPORTS NUTRITION / LUKED BV ("3ACTION").

Each order by the Customer implies full acceptance of the General Terms and Conditions. These General Terms and Conditions apply to all relationships between 3ACTION and its Customers, excluding any documents provided by the Customers. No deviation from the General Terms and Conditions is possible without a written contract signed by 3ACTION.

The Customer declares to be of legal age and fully legally capable. The Customer declares that their purchase of the Products is unrelated to their professional activity and is exclusively intended for private use.

Article 2: Orders

Product orders are made exclusively through the Website, following the indicated procedure. The order is final as soon as the Customer confirms their order by clicking on the "confirm" button. Once the order is confirmed, the Customer will receive an email confirmation of the acceptance of the order by 3ACTION.

The Customer agrees to provide accurate and correct information. 3ACTION reserves the right to cancel or not confirm the order in case of non-payment, incorrect address, or any other issue related to the customer account.

Article 3: Prices

The prices of the Products displayed on the Website are in Euro, including all charges and taxes, but excluding (1) shipping costs and (2) customs and import fees for deliveries outside the European Union. 3ACTION reserves the right to change the prices at any time but agrees to charge the Customer the prices that applied at the time of the order.

The shipping costs depend on your location and order amount. During checkout on our website, a summary of the shipping costs will be displayed before you complete the payment.

All our orders are shipped from our warehouse in Belgium. Only orders destined for Spain are shipped from Spain. For shipments outside the EU (+United Kingdom), import or customs duties may apply. The amount depends on the nature and value of the products, shipping costs, and other factors. If the destination country applies import duties, the customer is responsible for payment to the competent authorities.

Article 4: Payment

Online payments are processed through Shopify Payments (VISA, Mastercard, Paypal, Ideal, Bancontact/Mr. Cash, Apple Pay, Google Pay). Shopify Payments is a secure payment platform that verifies the validity of your card, card number, and access rights. Once everything is in order, the payment will be executed, and Shopify Payments will notify 3ACTION so that the order can be confirmed and shipped.

Article 5: Delivery

The Products ordered by the Customer will be delivered to the address provided by the Customer when placing the order. The Customer is responsible for verifying the correct delivery address when confirming the order. In case of an incorrect address, 3ACTION cannot be held responsible if the order cannot be delivered.

The normal delivery time for the products is:

• For Belgium, Netherlands, Luxembourg: 1 to 2 working days after payment of the order
• For France, Germany, Spain, Portugal, Italy, UK, Austria: 2 to 5 working days after payment of the order
• For the rest of the world: 3 to 7 working days after payment of the order

If the Product is out of stock or there is a delay in payment, 3ACTION reserves the right to postpone delivery. If 3ACTION does not have the Product in stock for an extended period, the Customer will be informed, and the Customer has the right to cancel the order. An order may be delivered by 3ACTION in several shipments.

Article 6: Right of Withdrawal

In accordance with the law regarding commercial practices and consumer protection, the Customer has the right to notify 3ACTION that they wish to cancel the purchase without penalty and without providing a reason within fourteen (14) days from the day after the delivery of the Product. In this case, the Customer must return the undamaged and unopened Product to 3ACTION at their own expense. Within thirty (30) days after receipt, 3ACTION will issue a full refund of the Product. Before returning the product, the Customer must inform 3ACTION via email at info@3actionsportsnutrition.com. The right to a refund expires if the products are opened, damaged, dirty, partially used, or returned incomplete by the Customer.

After this fourteen (14) day period, the delivery of the Product will be considered satisfactory, and, except for latent defects in the Product, no further complaint will be accepted by 3ACTION.

Article 7: Liabilities

Products comply with Belgian and European regulations. 3ACTION cannot be held responsible for the non-compliance of the Products with the applicable law in other countries.

3ACTION reminds Customers that the Products are dietary supplements and cannot replace a balanced diet and healthy lifestyle. The Products are not medicines. The Customer is solely responsible for their choice of products, storage, and usage. 3ACTION is not responsible for improper use of the Products.
3ACTION's liability is limited to the refund of the Product.

3ACTION accepts no liability in cases of force majeure, including government action, strikes (including those of usual suppliers and carriers), or if 3ACTION runs out of stock, or if the information provided by the Customer is incorrect or incomplete.

Article 8: Retention of Title

The products remain the property of 3ACTION until the full payment of the price (including shipping and packaging costs) has been made.

Article 9: Website Information

Despite the precautions taken by 3ACTION regarding the information on the site, inaccuracies or errors may occur. 3ACTION cannot be held responsible for these inaccuracies or errors.

Article 10: Personal Data

3ACTION declares that the data entered by the customer on the site will be processed in accordance with the Belgian Law on the Protection of Privacy of December 8, 1992. Customer data will be used by 3ACTION to send commercial offers or information about the products. In accordance with the legislation, the Customer has the right to access, modify, or delete their personal data by contacting 3ACTION.

Article 11: Intellectual Property

All elements of the site (trademarks, names, packaging, compositions, logos of products, etc.), whether registered or not, are part of the intellectual property of 3ACTION SPORTS NUTRITION / LUKED BV. Reproduction, in whole or in part, of the site, including texts, images, designs, etc., is strictly prohibited.

Article 12: Applicable Law

Disputes that cannot be resolved amicably will be settled by the Commercial Court in Hasselt (Belgium). Only Belgian law applies.
